Once the DSMO determine revised implementation guides or code sets are needed for industry effectiveness, there are several other entities involved in naming a HIPAA standard. They involve:
• The DSMO Steering Committee will provide annually to the National Committee on Vital and Health Statistics (NCVHS) a summary of the Change Requests that have been processed, with the DSMO recommendations.
• NCVHS reviews and provides recommendations to HHS
• HHS
- Initiates the HIPAA rule modifications according to the Federal Rulemaking process
o Notice of Proposed Rule Making (NPRM) is created and published
o There is a 60 (or possibly 30) Day Public Comment Period
o HHS reviews the comments
o HHS publishes a Final Rule which
- includes a compliance date for changes to standards
- cannot be less than 180 days implementation timeline
